State Income Tax

As you are probably aware, each State has its own income tax rules and forms. Our tax program will automatically calculate your state income tax return from your federal tax return information. Except for choosing your resident state, there is nothing for you to do to e-file your state return .

Note to Civil Union Filings

Some States allow by State law a Civil Union State Income Tax filing. To e-file as Civil Union Partners additional steps are necessary because of the difference between Federal and some State laws. Nothing really complicated, but a little more effort is required.

Filing as civil union always means that you must recompute your Federal income tax return. To do this, first each partner must file on the Federal return (1040) as Single, Head of Household, or Widow(er) with dependent. E-file each Federal return separately WITHOUT (at this time) e-filing your State return.

Then go back into the tax program, and recompute (add your income and expenses together) your Federal return as "married" filing status. Then run the State return (which will have you as "married" civil union filing status). Then, e-file just your joint state return and NOT the Federal return with the married filing status. Some states might not allow State only e-filing. In that case, you will have to mail a copy of your return. Just print out a copy and tell the tax program that you will mail in your State return.
